12DailyPro Refunds, New Site, Attorney

12DailyPro is making some progress on the Stormpay issue, as well as focusing its attention on other projects. It’s new site is scheduled to be live tomorrow afternoon, and I am very anxious to see what it’s going to be all about. They have also worked out their attorney situation and will seek legal action to get their money from Stormpay.

I wanted to take this time to update you on our progress with the StormPay issue and few other items.

StormPay
I am sure you are all under stably anxious to hear updates on our progress toward recovering our funds. Today, we made significant progress with the attorney who will be representing us in this matter. He has outlined a strategy for attempting to get our funds released by StormPay by whatever means at our disposal. We hope for swift action in the matter and will keep you as informed as things unfold, to the extent that we can without compromising the case.

Refunds
We will begin issuing a few refunds this evening and will process a batch of refunds daily. The order of the refunds will be: 1) Remaining Egold/EMO 2)Remaining Egold/Money Order, 3)Compounded EMO, 4)EMO. Please note that because we are unsure of how fast we will be able to resolve the StormPay situation, nor what the outcome of our efforts will be, we cannot provide any kind of time frame by which these EMO refunds will be issued. Also, due to StormPay’s random refunds and double payments that they are conducting with our funds and without our input, we are unable to yet give an accurate assessment to you of how we will deal with the StormPay refunds. Our hope is that by the time EMO payouts (currently on Dec. 8 expiration), catch up with where we left off with StormPay withdrawals, (Jan 23 expiration), that we will have some resolution on the StormPay issue and can announce a plan and/or for StormPay refunds.

Ticket System
Tomorrow, we will be revamping the ticket system to meet our current circumstances. In light of what has occurred and the fact that our goal is to be able to refund all pending and active upgrades, we will be closing all account issue related tickets. The new ticket departments will meet our current situation as well as provide support for the new site. There will also be a department for any missing EMO upgrades. Because there is no way for us to verify missing StormPay at this time, these will have to wait until we are able to gain access to our account data there. We strongly urge that you not submit tickets asking about the current situation; we will be posting updates daily and sometimes several times a day regarding progress on these matters. Our support staff has been extremely reduced, so we can have more funds available for refunds and basic operations. So, inundating the tickets system will only slow our ability to respond to the specific ticket issues we deem vital at this time.

Forum
We have now made all areas of the forum viewable to all guests, so that all of you can read it. We are unable to registrations at this time, due to concerns about mass spammers who have attacked our forum in the past.

Accounts Will Not Go Inactive
There have been some concerns by some members who have not upgraded in a while that their accounts will go inactive during this period. Due to current events, will be suspend the inactive status for anyone that would have normally been moved to that status, so as not to interfere with any refund they might receive.

The New Site
Thanks to the hard work of our technical staff, committed to LifeClicks despite all the happenings of the past week, we will be launching the new site by the end of the day tomorrow. You will notice that the 12dp homepage will change at that time, to reflect our current situation. The homepage will have three main links, one for the forum, one for members to login and check their account states and member news, and one to visit our new site.

He is now in stable condition and we continue to pray that he will not return to any critical state. I am truly blessed to have a family of 12dp members that cares. While waiting for 12dailypro and Stormpay issue to be resolved, don’t give up but search for other opportunities.

By now most of us know that StormPay and NetIBA were incorporated by the SAME person. Mr. John McConnell Jr is the registered agent, the principal officer, and the customer service contact of NetIBA. This man is also the registered agent of Stormpay. Steven Girsky is the CEO and Customer Service contact for StormPay. According to google maps: Map Link, they live 168 ft apart; it takes about 4 seconds to get from one house to the other.

If you have a complaint about NetIBA, before filing with the BBB, you should contact John Mcconnell at (931) 905-0112. If you reverse search this number at www.whitepages.com, you find it belongs to NetIBA at 1690 Golf Club Lane, Clarksville, TN 37043.

Who owns 1690 Golf Club Lane you ask? This 2 story, 6,068 sq ft, 30 office building is owned by John R. Mcconnell! Imagine that!

No, you’re not seeing double, NetIBA is at the same address as StormPay, in the building owned by John McConnell. The only difference is the phone number.

My question: is it legal to call a business owner at home? Of course, you are almost certain to lose your account, rather than get anything resolved so I wouldn’t recommend it! Additionally, according to the BBB, Steven Girsky is a lawyer working for Batson, Nolan, Brice, Harvey, & Williamson. However, Steven Girsky is not listed on their web page: www.bnbwg.com. Nor is he listed as a member of the Tennesee Bar Association. I don’t dare speculate on this and anyone else inclined to do so should cease and desist!

Looking back at the Tennesee property records, I looked up S. Third St to see who owns the building where Steven is/was a lawyer. It’s owned by BNBWG Realty. Hmm, Could those letters stand for Batson, Nolan, Brice, Williamson, & Girsky? Doing a search on google tells me I am correct. However, the BBB doesn’t have a record of this company and the address is the same address as the attorney’s office address. I guess BNBWG Realty doesn’t do much business?

Finally, according to the BBB, Stormpay has “an unsatisfactory record due to a pattern of complaints received. In the past 36 months, the company has received complaints specifically concerning the company’s failure to inform and follow up with its customers when it suspends accounts, failure to release funds in a timely manner and failure to resolve complaints directly with company management. The company has responded to each complaint presented by BBB. However, the company has not eliminated the pattern of complaint. The BBB Definition of pattern: - More than 2 complaints involving the same allegations usually within 12 months that are significant in relation to the company’s size and volume of business. YTD 2006, the company has received 8 complaints; in 2005, the company received 49 complaints; in 2004, the company received 6 complaints.

The proof is in the pudding folks. For all practical purposes, StormPay and NetIBA are the same company. Don’t be ripped off by them!

Additionally, If you are desperate to contact StormPay or it’s owner, I believe you can find enough information here to do so. You might have to think outside the box a bit though.

Clarksville Speedway gains new name, new sponsorship
Deal with StormPay.com will allow track to expand,
raise cash prizes

Sponsor helps track owners continue renovation By

A natural association of two enterprises involved in
dirt track racing turned into a business alliance
Friday when StormPay.com became the primary sponsor of
Clarksville Speedway.

StormPay.com — a payment processing company for online
auctions — and the speedway agreed to a two-year deal,
with an option for an additional two-year sponsorship.
Financial were not disclosed, but Steve Girsky,
CEO of StormPay.com, said sponsorship dollars will
allow the renamed Clarksville StormPay.com Speedway to
continue its expansion and renovation, while
increasing the cash awarded to race winners.

Girsky and speedway owners William and Tammy Scogins
began discussions about the business venture two weeks
ago. StormPay.com is the primary sponsor of the Crate
Racin’ USA Series, which has grown from a regional
dirt racing event into a national racing series in
only one year.

StormPay.com’s involvement in the speedway, a
clay-oval dirt track on Needmore Road, is a separate
business deal from its sponsorship of the racing
series.

“Anything and everything we do out here will be
focused around StormPay.com,” William Scogins said.
“It’s a great handshake that we’ve been able to find
somebody in our own town, in our community that’s
going to take interest in racing the way they’ve had.”

StormPay.com’s involvement with the speedway also
includes the Friday night drag racing series and the
go-cart track.

The speedway is undergoing its most extensive
renovation since the Scoginses bought the facility
five years ago. Corporate suites and a new media tower
are under construction.

Before StormPay.com became the primary sponsor of the
Crate Racin’ USA Series, CEO Steve Girsky admits he
wasn’t much of a racing fan.

Now, he can’t watch enough racing, and the company he
helped launch four years ago has increased its impact
on the local racing scene.

StormPay.com — a payment processing company for online
auctions — became the primary sponsor of Clarksville
Speedway, the 40-year-old dirt track that launched the
career of Clarksville’s Jeff Purvis, and is the
central track for the launch of the Crate Racin’
Series, which has grown from a regional racing event
into a national series.

The two-year deal, with an option for an additional
two years, became official when Girsky and speedway
owners William and Tammy Scogin made the venture
officially known Friday.

With StormPay.com having its headquarters in
Clarksville, becoming the primary sponsor of the
clay-oval dirt track was an ideal fit.

“Truthfully, the sponsorship of our local track in the
hometown of our corporate headquarters was a natural
extension of our racing endeavors of what we’ve
undertaken in the past year,” Girsky said.

StormPay.com, which was launched in 2002, does
business in 200 countries and is expanding its
services to include e-mail accounts, Web pages, domain
registry and Web-based tools.

With this major sponsorship endeavor, the Clarksville
StormPay.com Speedway is positioned to speed up its
current expansion and renovation, while providing
bigger purses for the Crate Racin’ USA Series.

“We haven’t ear-marked money for any particular
purpose, other than set aside monies from the
sponsorship to these purses to make them bigger,”
Girsky said.

Most dirt tracks pay $400 to their winner, but the
speedway will pay its winner $800.

The new Clarksville StormPay.com Speedway is currently
building corporate suites — a first for a dirt track —
in addition to a new media and scoring tower.

“We’re trying to give the community a place to have
people come in, businesses come in, and have a place
to entertain their clients,” Tammy said. “We’re hoping
that these suites go well this year, and that maybe if
word gets out, that we can add another roll of them
next year.”

Added Girsky: “We’ve been to several (dirt tracks)
here recently and we haven’t come across one yet that
has suites.”

Last season, the speedway was the host site for 200
events — including some that weren’t race related —
and averaged 1,200 in attendance with its stock car
series.

“All these corporate businesses, from mom and pa, to
2,000 people, we can entertain out here,” Tammy said.
“We can give them a little place they can do something
at.”

Other renovations to the track facility include
replacing the fence alongside the road in front of the
track, in addition to building a new entrance and new
signs.

“It is a good venture for both companies. It’s an
asset for us we know, and we hope it’s an asset for
them,” William said. “Tammy and I have tried to
improve the place the longer we go.”

The speedway has invested $30,000 in transponders to
assist in scoring the cars and the laps they’ve run.

StormPay.com will also help drivers find corporate and
business sponsors to cover the costs of their
operation.

“For these guys, it costs a lot of money to race and
expand the base of the sport,” Girsky said. “If we can
get sponsorship for the drivers, we’ve helped another
set of fans.”

StormPay.com’s interest in auto racing was initiated
after it was approached by a Nextel Cup team looking
for sponsorship. Girsky met with Purvis, who spent
nearly 20 years racing on the ARCA, NASCAR Busch and
then-Winston Cup series, to learn what would be
involved in sponsorship.

It was Purvis who tipped StormPay.com, which is the
primary sponsor of Purvis’ Crate Series car, about the
Crate engine, and its future in dirt track racing.

Motors for late model cars can cost $40,000, but the
Crate engines cost between $3,000 and $5,000, and
their speeds and horsepower are similar to those of
the more costly motors.

“This whole series is the wave of the future,” Girsky
said. “You can race a car and buy an engine from
$3,000 to $5,000 dollars, and race against
NASCAR-level competition.”

On August 7, 2003, the Tennessee Securities Division of the Department of Commerce & Insurance issued an “Order to Cease and Desist” (file number 03-020) with TymGlobal, Inc., StormPay, Inc. and John R. McConnell, Jr.

The order states that TymGlobal and StormPay are under common ownership and/or control. TymGlobal operates an internet website which is registered to StormPay. On the internet website, respondents are operating a pyramid and/or Ponzi scheme promising large returns on investments for participating in the scheme. The order further states that TymGlobal has not registered any securities offerings with the Division pursuant to Tennessee Securities Act of 1980. Nor has the company registered with the Division as a broker-dealer, agent of a broker-dealer or investment adviser. Also, the respondent StormPay has not registered any securities offerings with the Division nor has the company registered with the Division as a broker-dealer, agent of a broker-dealer, or investment adviser. John R. McConnell, Jr. has not registered with the Division as a broker-dealer, an agent of a broker-dealer or as an investment adviser.

Potential investors were given the opportunity to invest in both partnership shares as TymGlobal as well as to participate in various Ponzi schemes. Respondents promised a high return. The offering of participation in the schemes sold by the respondents is an investment contract and thus, a security under the act.

The Division ordered the respondents TymGlobal, StormPay and John R. McConnell, Jr to cease and desist the conduct of a broker-dealer in the state of Tennessee until such time as it effectively registers with the Division. The order did not intend to prohibit lawful conduct of the respondents.

Since talking to the governor’s office in Tennessee Stormpay has many complaints in the past about issues frozen accounts. i spoke with Becky Bradley and she has asked that you email any and all information to her about Stormpay wrong doing her email address is becky.bradley@state.tn.us apparently she wants to help get this resolve in a timely manner.
